Account Point of Contact; Account Ownership:

You must register for an account (the “Account”) to access and use the Services by providing your full legal name, current address, phone number, valid email address, and certain other information indicated as required. You agree that all such information is current and accurate. We will use the email address you provide as the primary method of communication, including for billing matters. We may reject your application for an Account for any reason at our sole discretion.

Responsibility:

We may suspend the Purchased Services to You with or without notice and without liability if: (a) We reasonably believe that You are using the Services in violation of the Agreement; (b) You don’t cooperate with Our reasonable investigation of any suspected violation of the Agreement; (c) We are required by law, or a regulatory or government body, to suspend Your Services, or (d) there is another event for which We reasonably believe that the suspension of Services is necessary to protect Our other customers & merchants. We will use commercially reasonable efforts to give You advance notice of any such suspension unless We determine that a suspension on shorter notice or without notice is necessary to protect Us or Our other merchants & customers from imminent risk;

Image Guidelines:

Each image we receive is reviewed. While most images will be accepted, we will not accept any images containing the following:

(a) Any name, trademark, logo, slogan, work of art, brand, or logo of a third party that is owned by the third party.
Images that feature celebrities, professional athletes, actors, cartoon figures, or computer game figures as their sole focus.

(b) Content or images that demonstrate anti-government behavior or sentiment or content that violates any law or regulation.

(c) Content or images that contain violence, blood, dead animals, indecency, nudity, or semi-nudity.

(d) Texts or images that are culturally or socially insensitive or those that depict alcohol, tobacco, gambling, firearms, online or role-playing games, or adult entertainment.

(e) Displays of political or religious views, opinions, or beliefs.

(f) Content that is defamatory, disparaging, libelous, discriminative, or provocative.

(g) Images or texts that might interfere with merchants’ acceptance of gift cards.

Any orders containing the use of any of the following will be in violation of our terms of service and will be canceled with or without notice and without liability.

Content & Ownership/ Intellectual Property:

Our Services allow You to upload, post, transmit, publish, share, store, or manage content, including data, graphics, links, photos, music, sound, messages, videos, and other materials (altogether, “Your Content”). You are solely responsible for any and all of Your Content. You represent and warrant that (i) You have all necessary rights to distribute Your Content via Our Services and (ii) Your Content does not violate the rights of any third party. You hereby grant Us a worldwide, royalty-free, non-exclusive license to host and use Your Content in order to provide the Services to You. You are responsible for undertaking necessary measures to ensure the security, confidentiality, and integrity of all Your Content transmitted through or stored on Our servers. You are responsible for any of Your Content that may be lost or unrecoverable through Your use of the Services.

Prices:

All published prices on BizGift.com are subject to change at any time and at the sole discretion of BizGift.

BizGift Cards:

BizGift cards can be activated and redeemed for gift cards from participating merchants. The value of the BizGift card will be determined by the individual or business that created the BizGift card. BizGift is not responsible for the quality or availability of any goods or services participating merchants provide.

BizGift is not responsible for ensuring there is a sufficient fund balance available to Activate a BizGift. That responsibility is of the BizGift Account holder. BizGift guarantees that any Activated BizGift is Redeemable for a Gift Card in our Marketplace.

BizGift Cards cannot be resold. 

Activation & Redemption:

BizGift cards must be activated and redeemed for a Gift Card through the BizGift platform. The redemption process may require you to provide certain information, including your name and email address. BizGift is not responsible for any loss or damage to your BizGift card or any unauthorized use of your BizGift card. Once your BizGift card is activated and redeemed for a brand merchant gift card, the terms and conditions of the brand merchant gift card program apply. 

Fees:

BizGift may charge fees for its platform, including fees for creating and distributing BizGift cards. Any applicable fees will be disclosed to you before using the BizGift platform.

Termination:

BizGift reserves the right to terminate your use of the BizGift platform at any time and for any reason, including, but not limited to, a breach of these Terms. Upon termination, all rights and licenses granted to you under these Terms will immediately terminate.

Limitation of Liability:

BizGift shall not be liable for any damages arising out of or in connection with your use of the BizGift platform or your receipt and use of a BizGift card. This includes, but is not limited to, direct, indirect, incidental, special, and consequential damages.

Dispute Resolution:

Any dispute arising out of or in connection with these Terms will be resolved through binding arbitration. The arbitration will be conducted in accordance with the rules of the American Arbitration Association of Williamson County, TN.

Print & Color:

BizGift reserves the right to determine the print method and colors at its sole discretion. Orders are generally printed through a 4-color dye sublimation process (CMYK). The lamination and/or UV coating process used during card production may result in subtle color variations between the proof and the actual card. Reorders may also experience subtle color variation from the original card. BizGift reserves the right to determine the appropriate print finishing (e.g. lamination, magnetic stripe, packaging).

Shipping:

The shipping address must be provided to BizGift. Changes to the shipping address after packaging may be subject to charge. BizGift will choose the shipping carrier, shipping method, and whether to ship a product in part or in full at its sole discretion. Specific shipping instructions must be communicated to BizGift. Rush shipments are subject to additional charges.

Cancellation:

Cancellations before production are available but may be subject to a $25.00 charge. Cancellations post-production are subject to a $25.00 charge and full print cost.

Production Errors & Damages:

Customers must report, in writing, any alleged product errors, defects, damages, or otherwise to BizGift within three (3) business days from receipt of the product. Failure to report constitutes waiving any claim or right against BizGift related to the product. In the event BizGift concludes there has been a production error or damages, BizGift will remedy the error or reproduce the product. BizGift will not issue a refund for any production errors or damages.

Returns & Refunds:

All Products on BizGift.com are custom and made to order; as such, all sales are final.

Data Ownership:

All data and information collected by BizGift through the use of its platform shall remain the property of the individual or business that has registered to use the platform. BizGift shall have no ownership or control over such data and shall not use it for any purpose other than to facilitate the use of its platform.

BizGift shall take reasonable measures to protect the data and information of its users and prevent any unauthorized access, use, or disclosure. However, users of the platform are solely responsible for the accuracy, completeness, and legality of the data and information they provide.

BizGift shall have the right to use aggregated and anonymized data to improve the platform's performance and provide insights into industry trends and customer behavior. Such data shall not identify any individual or business and shall be used solely for the purpose of improving the platform's performance and services.

Entire Agreement:

These Terms constitute the entire agreement between you and BizGift and supersede all prior agreements and understandings, whether written or oral, relating to the subject matter of these Terms.

Changes to Terms:

BizGift may modify these Terms at any time. The modified Terms will be effective immediately upon posting on the BizGift platform. Your continued use of the BizGift platform after any such modification constitutes your acceptance of the modified Terms.
